Terms and Conditions
These Terms and Conditions (“Agreement”) apply to all bookings made with Ellen Et Les Garçons ("we", "us", "our"). By confirming a booking, the client (“you”) agrees to the terms outlined below.
1. Booking & Deposit
To confirm a booking, a non-refundable deposit of 50% of the total performance fee is required. The booking is only secured once this deposit is received.
The remaining balance is due no later than 7 days before the event date, unless otherwise agreed in writing.
2. Cancellation & Rescheduling Policy
By the Client
We understand that plans can change, and we aim to be as fair and accommodating as possible:
Cancellations:

More than 90 days before the event: Full refund of all payments made.

61–90 days before the event: 75% of the deposit will be refunded.

31–60 days before the event: 50% of the deposit will be refunded.

15–30 days before the event: The deposit is non-refundable, but no further fees will be charged.

Within 14 days of the event: The full agreed fee is due, even if the event is cancelled.
Rescheduling:

You may reschedule the event with no penalty if we are available on the new date.

If we are unavailable on the new date, the booking will be treated as a cancellation under the terms above.

Requests to reschedule must be made at least 14 days in advance.

Rescheduling within 14 days may still be possible but may incur an administrative fee.
Exceptional Circumstances:
If cancellation or rescheduling is due to unforeseen compassionate or force majeure reasons (e.g., serious illness, emergency), please contact us directly. We will always aim to offer a fair and flexible resolution.
By the Band
In the unlikely event that we must cancel due to illness, emergency, or other force majeure:

You will receive a full refund of all payments made.

We will do our best to offer a suitable replacement band or musicians from our professional network, subject to your approval.
3. Luxury Event Clause (High-End or Bespoke Bookings)
We specialize in premium and luxury events, and are committed to delivering a seamless, high-standard experience.
Presentation & Style:
If you have specific requests for dress code, themed attire, set design, or performance style, these must be communicated at least 30 days in advance to ensure we meet expectations.
Venue Requirements:
For high-end venues such as listed buildings, estates, or yachts, please inform us of any special access, load-in restrictions, or technical considerations ahead of time. Additional setup time, handling, or logistics may incur extra fees.
Sound & Technical Limitations:
Please inform us of any sound limiters, curfews, or venue rules that may impact performance. We cannot be held responsible for issues that arise from uncommunicated restrictions.
Special Requests & Extended Hours:
Requests for additional sets, background music, or overtime should be discussed at least 14 days before the event. These may involve additional fees. We will accommodate last-minute requests if possible but cannot guarantee availability.
Damage & Liability:
We carry public liability insurance and take great care of our equipment. However, the client is responsible for any damage caused by guests to instruments or gear. We are not liable for damage or delays resulting from venue faults, unsafe conditions, or third-party interference.
Exclusivity (Optional Premium Service):
If requested, we can offer an exclusivity agreement, ensuring we do not book another event of similar profile on the same day. This must be agreed in writing and may involve a premium rate.
4. Performance Requirements
The client agrees to provide:

A suitable covered performance area, especially for outdoor events.

Electricity access if amplification is required.

Reasonable access for setup, soundcheck, and breakdown.
5. Delays & Overtime
We strive to be punctual and flexible. However:

If the event runs significantly late and affects performance time, additional charges may apply.

We are not responsible for delays caused by venue access issues, guest timing, or schedule changes.
6. Use of Media
We reserve the right to use photos or video/audio recordings of performances for promotional purposes, unless otherwise agreed in writing.
If you plan to hire a professional photographer or videographer, we’re happy to liaise with them directly.
7. Force Majeure
We shall not be held liable for any failure to perform due to events beyond our control, such as:

Extreme weather

Accidents or illness

Government restrictions
-
Natural disasters
In such cases, we will make every effort to reschedule or refund as fairly as possible.
